LOUISVILLE, Ky. (WDRB) — A New Albany man told witnesses he fatally shot his brother earlier this week because the 24-year-old was trying to rob him.
That’s according to court documents that detail interviews with witnesses after Antonio Bautista was gunned down by 19-year-old Andreas Bautista in a New Albany neighborhood Tuesday evening.
It happened in the area of Wolfe Trace, near Lynn Road, which is not far from East Daisy Lane and Grant Line Road. A news release from New Albany Chief Todd Bailey said Andreas Bautista “shot his brother Antonio Bautista during an altercation.”
A woman identified by investigators as the accused killer’s girlfriend told police she heard several gunshots nearby after Andreas left their residence on Lynn Road, according to a probable cause affidavit. She told investigators Andreas Bautista returned and said “I just shot my brother” and explained that Antonio Bautista was trying to rob him before he opened fire.
Two other witnesses in the home made similar statements.
Investigators reviewed security camera footage from the Lynn Avenue home that showed Andreas Bautista leaving the residence before numerous gunshots are heard. The footage then allegedly shows Andreas Bautista going back into the home.
Police said Andreas Bautista can be heard on the video saying: “Call the cops. I killed him. He’s over there on the ground.”
When police questioned Andreas Bautista after the shooting, he declined to waive his Miranda rights, allegedly saying “I did what I had to do. I was in fear for my life.”
A 70-year-old woman who lives in the neighborhood was apparently walking her dog when she was hit in the leg by gunfire. She was taken to UofL Hospital in downtown Louisville.
Police said Antonio Bautista had been shot twice — once in the face and once in the back of the head. No weapons were found near his body.
Andreas Bautista is charged with murder and aggravated battery.
