TRENTON, N.J. — A new bill, S-3608, introduced by Senator Paul Sarlo (D-Bergen/Passaic), would allow restaurants, bars, distilleries, and breweries to continue outdoor service, a practice that expanded during the Covid-19 pandemic. The bill passed a Senate committee on Monday.
The legislation aims to extend provisions that are set to expire on November 30, 2024. These provisions have allowed businesses to use outdoor spaces such as patios, decks, parking lots, and sidewalks for both food and alcohol service. Senator Sarlo, who is also the mayor of Wood-Ridge, said the outdoor service has been “a real success for the restaurants and the communities they serve.”
The bill would require businesses to comply with local ordinances regarding health, safety, fire, and zoning regulations. A separate process for new businesses seeking permits and an additional step for those serving alcohol would also be introduced.
The Senate Budget and Appropriations Committee approved the bill unanimously.
