Wilmington, DE — The Daily Caller News Foundation (DCNF) and Judicial Watch have requested that a Delaware court reopen their case seeking the release of President Joe Biden’s Senate records, which are held at the University of Delaware.
This request follows findings from Special Counsel Robert Hur’s February report, which contradicted the University of Delaware’s previous claims that no tax dollars were used in processing the records sought by DCNF and Judicial Watch. In July, the Delaware Supreme Court had ruled in favor of the university, preventing the release of these documents.
“The stunning revelations from the Hur report extend beyond the president’s memory lapses and mental state,” stated Michael Bastasch, Editor-in-Chief of the DCNF. “The court needs to reopen this case to determine whether the University of Delaware lied.”
Judicial Watch initially filed the lawsuit in July 2020 on behalf of itself and DCNF after the university denied their request for the records, arguing that the records were unrelated to the expenditure of public funds.
The documents sought include agreements related to the storage of 1,850 boxes and 415 gigabytes of records from Biden’s Senate career from 1973 to 2009, communications between university and Biden’s staff, log sheets of visitors to the collection, and the actual collection records.
The motion filed by DCNF and Judicial Watch with the Delaware Superior Court asserts that the Hur report shows President Biden directed his former staffers in reviewing and cataloguing the Senate Papers, with the university bearing the cost. The motion argues that such payments constitute consideration on Biden’s behalf, contrary to previous representations by the university.
Biden’s records have been housed at the University of Delaware since 2012, with the condition that they would not be publicly released until properly processed and archived, according to the university’s website.
