Alan Peter Gardner, a distinguished partner at Bennett Jones LLP in Toronto, passed away on January 5, 2025. He was the beloved husband of Dominique Hussey, the CEO of Bennett Jones LLP.
Born in Ottawa, Alan was known for his brilliance, talent, and magnetic personality. He was a devoted family man, cherishing his relationships with his siblings—Karen, Susan, and Paul Gardner—and his in-laws, Karlene, Andrew, and Alia Hussey, and Peter Sanagan.
He was also a loving uncle to his nephews and nieces: Cameron, Andrew, Emily, Stephen, Brittany, Alex, and Dahlia. Alan was predeceased by his father, David Gardner, during his childhood, and his mother, Yvonne Gardner, who passed away just five days before him.
Professionally, Alan was a prominent figure in securities and commercial litigation, focusing on regulatory investigations. He represented clients including investment banks, broker-dealers, technology companies, resource companies, and manufacturers.
His expertise was sought by board members, senior management, and special committees of public companies involved in regulatory investigations or shareholder litigation.
Alan was also frequently engaged in conducting internal investigations related to the Corruption of Foreign Public Officials Act (CFPOA) and managed related agency inquiries.
Colleagues and clients held Alan in high regard, noting his composure in high-pressure environments and his adeptness at navigating complex situations involving skeptical regulators and stressed directors.
His career included significant experience in New York, where he worked with Cadwalader Wickersham & Taft LLP from 2001 to 2005.
During this time, he conducted numerous internal investigations, including representing CIBC World Markets in market timing and late-trading investigations conducted by the United States Securities & Exchange Commission and the New York Attorney General.
He also represented Bear Stearns in the McKesson litigation in the Northern District of California. Alan’s personal life was marked by his resilience and courage.
He faced an aggressive lung disease with bravery and underwent a double lung transplant. Despite the challenges, he confronted complications with an enduring will to survive. He passed away peacefully in the arms of his wife, Dominique.
A visitation is scheduled for Thursday, January 16, from 4 to 8 p.m. at Mount Pleasant Funeral Centre, located at 375 Mount Pleasant Road in Toronto. A celebration of Alan’s life will be held at a later date.
